If a person wants to get a copy of a person’s arrest records and or criminal convictions then he/she can do it by putting a request to the police department, your states criminal justice division or making a request at your county clerk of courts office. The request should be made at the department which has all the records. There are a few states where you can get a copy of your arrest record but you cannot make a copy of somebody else’s arrest record. Making a copy of someone else’s arrest record is against privacy law, however you can access public records under the FOIA. You have to fill a form, get the person’s permission and you have to pay the fee for copies.

However you can access some websites that let you see peoples criminal records without having to get a persons consent. This is available because of the freedom of information act and criminal record databases.

Procedure for obtaining the copy of the arrest records

Step 1
Go to your town or city police department and file a request to search for arrest records. They will charge fees from you and you will have to give proof of your identity as well. So be sure to bring your state ID and a bit of cash.

Step 2
Local city arrest records can also include the county arrests. But still you should confirm it with the county sheriff’s department if you want to take the copy of the arrest record that had happened at the county level. You will have to show valid photo identification and they will charge a little fee from you as well.

Step 3
The Attorney General or the Department of Justice of your state can provide you copy of the complete record of the total arrests and convictions of a person that has been convicted or charged in that state. If you are looking for the appropriate agency then search it online on the Internet. Forms are available on the agency website or you can take the forms from the office of the state police. You will have to pay the fees when you send back your form.

Step 4
Federal Bureau of investigation is responsible for keeping the Federal criminal arrest records. The FBI website provides you the information through which you can obtain the copy of a person’s criminal history. You need a cover letter stating the reason for the copy of your arrest record, fingerprints and money order or check.

Most of the jurisdictions allow you to view your own criminal history and permission for someone elses record. Be sure to have your identity proof before doing a criminal background check on yourself or someone else..
